End User License Agreement (EULA)

Welcome to CamScan. This End User License Agreement ("Agreement" or "EULA") governs your use of the CamScan mobile application ("App") and any related services we provide (the "Services"). By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, please do not use the App.

1. Eligibility and Account

You must be at least 13 years old to use the Services. Some features may require account creation. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activities that occur under your account.

2. License Grant and Acceptable Use

Subject to this Agreement, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the App solely for your personal or internal business use. You agree not to use the Services for any unlawful purpose, not to copy, modify, reverse engineer, decompile, or disassemble the App, not to attempt to bypass any security or access control, and not to infringe the rights of others.

3. User Content and Permissions

Certain features allow you to upload or process content such as images, files, or documents ("User Content"). You retain any rights you hold in User Content. You grant us a worldwide, royalty-free, transferable, and sublicensable license to host, store, process, and display User Content as reasonably necessary to provide and improve the Services, consistent with our privacy practices. You represent that you have all necessary rights to upload and process User Content and that it does not violate any laws or the rights of third parties.

4. Fees and Payment

We may offer both free and paid tiers. If you purchase a paid Service, you agree to pay the fees shown at the time of purchase and any applicable taxes. Prices and eligible currencies may change where permitted by law. Any term-specific pricing will remain in effect for the stated term. You are responsible for charges from your network provider and any currency conversion costs.

5. Intellectual Property

We and our licensors own all right, title, and interest in and to the App and the Services, including all software, trademarks, and other intellectual property ("CamScan IP"). Except for the limited license granted here, no rights are transferred to you. You may not use CamScan IP without our prior written permission.

6. Third-Party Services

The Services may include links to or integrations with third-party offerings. We are not responsible for, and do not endorse, third-party services. Your use of third-party services is at your own risk and may be governed by separate terms and privacy policies.

7. Privacy

We collect and process personal data as necessary to operate and improve the Services. For details about the types of data we collect, how we use it, and your choices, please review our Privacy Policy. By using the Services, you consent to our processing of personal data consistent with the Privacy Policy.

8. Suspension and Termination

We may suspend or terminate your access to the Services, in whole or in part, if we reasonably believe you have breached this Agreement, created risk or possible legal exposure for us or others, or where required by law. You may stop using the Services at any time and may terminate this Agreement by deleting your account. Upon termination, the license granted to you ends immediately.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and availability.

10. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or business, arising out of or related to your use of the Services or this Agreement. Our total liability for any claims relating to the Services will not exceed the amounts you paid, if any, for the Services in the twelve months preceding the event giving rise to the claim.

11. Force Majeure

Neither party will be liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, acts of government, war, terrorism, civil unrest, labor disputes, or internet or service provider failures.

12. Changes to the Services and this Agreement

We may modify the Services and this Agreement from time to time. Where required or reasonably practicable, we will notify you before material changes take effect. Your continued use of the Services after the effective date of an update constitutes acceptance of the revised terms.

13. Governing Law and Dispute Resolution

If mandatory consumer protection rules require local law to apply, that local law governs. Otherwise, this Agreement will be governed by the laws of the jurisdiction where we are based, without regard to conflict-of-laws principles. Where permitted by law, you and we waive any right to a jury trial or to participate in a class action. Venue for disputes will be in the courts of our principal place of business, unless applicable law provides otherwise for consumers.

14. Notices

We may provide notices by in-App messages, email, or postings within the Services. You are responsible for keeping your contact information current.

15. Miscellaneous

This Agreement is the entire agreement between you and us regarding the Services and supersedes any prior agreements. If any provision is found unenforceable, it will be severed and the remaining provisions will remain in full force. No waiver of any term is a continuing waiver. Headings are for convenience only and have no legal effect.
